Town planning law, land development and public property
The firm assists its clients in setting up urban planning operations by ensuring the feasibility of the operation in the light of the applicable urban planning documents (PLU, Loi Montagne, Loi Littoral), by monitoring the public information and participation procedures (environmental assessment, consultation, public enquiry) and by supporting the process of obtaining the permits required depending on the nature of the project (building permits, commercial operating permits, ICPE authorisations, environmental permits, ERP authorisations).
The firm also handles litigation in these areas, both as plaintiff and defendant.
It also carries out regulatory audits as part of property acquisitions.
Lastly, combining skills in public law and real estate law, the firm is involved in public appropriation operations (pre-emption, expropriation), management and occupation of public and private property (state authorisations and agreements, administrative or common law leases) and development of property, particularly in support of public projects.
Significant experiences
- Advising a property investor and carrying out a legal audit relating to aspects of town planning law and public property law in connection with the acquisition of stakes in a company in charge of a property project on public port land.
- Advising and representing a company in a number of contentious proceedings following the termination of a public domain occupation agreement for reasons of public interest.
- Advising and representing a Parisian university in its defence against the many appeals lodged against its establishment in a ZAC (urban development zone) (building permits, ERP authorisations).
- Advising a local public development company, including an analysis of the current ZAC and a definition of the procedures to be implemented for its completion.
- Advising a national public institution in the structuring of related property projects (sales of volumes) developed in connection with the new stations on line 16 of the Grand Paris Express.
