Public procurement law

The firm’s expertise covers all public procurement: public contracts, concessions, PPPs, and defence and security contracts.

The firm assists its clients, both contracting authorities and companies, in the project definition and structuring phase, as well as in the contract award phase.

It is also involved in the performance of these contracts. As such, it advises its clients on the application of the contractual clauses governing the technical, administrative and financial aspects of the project, particularly in the event of performance difficulties (contractual penalties and sanctions, unforeseen services or circumstances, payment difficulties, amendments, transfer, termination).

Finally, the firm assists contracting authorities and companies with all pre-litigation and litigation relating to these contracts: claims, alternative dispute resolution (mediation, conciliation, settlement), interim relief (pre-contractual and contractual, interim expertise, interim provision), appeals challenging the validity of the contract, claims for compensation, etc.

Significant experiences

  • Advising the first SEMOP set up to operate a port concession in Alsace on the monitoring and execution of the 30-year public service concession contract.
  • Advising a company managing gas transport and storage infrastructures in connection with the award of a global performance contract for the design and construction of a hydrogen distribution facility for refuelling regional express trains.
  • Advising a company in connection with the award of concessions for the construction and operation-maintenance of electric vehicle charging facilities at motorway service areas on the concession network.
  • Advising a transport company in connection with the award of public contracts for combined natural gas (CNG) filling stations for RATP buses.
  • Advising a semi-public company in charge of building a power station to supply a nickel processing plant and New Caledonia’s public electricity grid, backed by a floating infrastructure for storing and regasifying liquid natural gas.
  • Advising the winning consortium and then the project company during the award and closing phases of major PPPs, such as the Balard Armed Forces Ministry, the Palais de Justice des Batignolles in Paris and the Université Européenne de Bretagne, the first digital university in France.
  • Advising the public authority on the monitoring and execution of several PPPs during their initial years of performance: advising the Hauts de Seine department on the Seine Musicale, the Lyon metropolitan authority on the renovation of the northern ring road in Lyon, and the University of Paris 7 on the construction of university buildings in the Paris Rive Gauche urban development zone.
